Holidays In Newquay Rental Conditions

The conditions as below apply to all rentals of Holidays In Newquay's Accommodations bookings made through Holidays in Newquay (incorporating Diamond Management Service) or any third party booking agents.
The Contract
1a. The contact entered into is between the (establishment) (the proprietor) and the person completing the rental form (the hirer).
1b. The contract is not effective until the required payment has been received and a confirmation email has been sent by D M S to the hirer and the rental will cease when the rental monies has run out.
Bookings
2a. Bookings cannot be accepted by persons under the age of 18years unless see below, parties where the majority of the members are under 18years (except families and supervised groups) without prior arrangement with D M S
2b. The number of person occupying a property must not the number the apartment can hold.
2c. The person making the booking will be responsible for all persons staying and should ensure that they are all aware of the rental conditions.
2d. The owner (employee) reserve the right to decline any rental or refuse to hand over a key to any person who has not complied with the rental conditions.
2e. All bookings are non-transferable.
We recommend that personal holiday insurance is taken out to cover any cancellations.

Reservations
3a. To secure a reservation we require a deposit of 25% of the total cost of the holiday or if the started date is less than 35 days before arrival the total cost is due in full.
3b. The balance of the holiday cost will automatically be taken from the card supplied when making the booking, 
3c. If the balance is declined the owner reserves the rights to cancel the booking and retain the deposit.
3d. All deposits are non-refundable and non-transferable. The deposit will be returned if the rental cannot be accepted for any reason.
Cancellations
4a. Once a booking is confirmed the hirer is responsible for the total cost of the holiday.
4b. In the event of a cancellation by the hirer, the owner (employee) will endeavor to re-let the property and if successful may refund paid less the 25% deposit which is non-refundable.
4c. If the hirer cancels after the balance due date, but they have not paid the outstanding balance they will still be liable for the outstanding balance unless the property can be re-let.
4d. All cancellations must be confirmed to the owner (employees email.
Booking Alterations
5a. Any changes in the holidays dates will be subjected to the agreement of the owner (employee).
5b. Any request by the hirer for transfer of the booking to another property / person will be treated as a cancellation of the original booking.
5c. If for reasons beyond the control, the owner has to cancel or alter arrangements made for the hirer they will make every effort to offer an alternative property if one if available
Damage, Loss and Nuisance
6a.The hirer agrees:
Not to cause nuisance or annoyance to occupants of nearby properties. To allow reasonable access to the property by the owner (employee) if it is deemed necessary, any time day or night. To pay for any damage or loss however caused, excluding reasonable wear. And any excess usages of utilities, and other charges if deemed necessary. Not to bring illegal substance in to the accommodation or grounds and to not smoke within the accommodations. Not to entertain anyone that is not named. The hirer / party leader is reasonable for leaving the accommodation in good order and clean condition; otherwise a cleaning charge will be levied.
6b. If in the opinion of the owner (employee) any person is not suitable to continue their occupation of the property because of unreasonable behaviour, damage or nuisance to other parties and employee's, the contract may be discharged and the owner (employee) may repossess the property immediately. Please note that if only one member of the party break the conditions members of the party will be asked to leave. If you have more than one accommodation booked than all accommodations will be asked to leave.
The hirer will remain liable for the whole cost of hire and no refund shall be due.

Occupancy
7a. The accommodations are available after 4pm on your arrival day. Departure is by 10am. Any unauthorised late departure will be charged at additional days hire. And if necessary all cost of relocating the next party due to arrive in that apartment.
7b. Any extra person/s entertained in the accommodation that is not named /or excess that maximum the apartment can hold are charged at the starting rate of £20.00 per person per visit / night. Having extra bodies may result on your holiday be terminated early with no refund.
7c. Heating is supplied in winter months or if deemed necessary earlier.
(In line with our insurance policy boilers are padlock closed. Heating comes on 15min every hour.)
7d. Standard Usage of Electric, gas & water is included.
7e. One parking spare per property booked will be located on the dinner room table for your arrive
Pets
8a. Dogs permitted by request only (charges apply). (Maximums of two dogs per booking)
Out of Hours Call outs
9a. Any non-emergency call out will be liable to a call out charge starting from £25.00
Description
10a. Whilst the owner (employee) makes every effort to ensure that the accuracy of property descriptions, descriptions are inevitably subjective and are for guidance only. If there are any points of particular importance please contact the owner (employee) to clarify information.10b. Whilst the owner (employee) has taken all responsible steps to ensure that the information contained in its brochures, tariffs, leaflets. Website and advertisement are accurate the owner (employee) reserve the right to alter, substitute or withdraw any service, facilities or amenity.
Liability
11a. The owner (employee) cannot accept responsibility for any material loss, personal injury, damage, additional expense or inconvenience directly or indirectly caused by or arising out of the property and its, plumbing, gas, electrical or otherwise, exceptional weather or other matters over which we have no control.
11b. No responsibility is accepted for loss or damage of property vehicles or vehicle contents belonging to hirer or any member of the party during their occupancy.
11c No child is to be left in any accommodation on their own at any time.
Complaints
If in the opinion of the hirer there are grounds for complaint; it is the duty of the hirer to take it up with the owner or employee immediately and in any event before departure to allow remedial action to be taken.
It is specifically agreed that failure by the hirer to notify the owner (employee) of any compliant in accordance with the timescale set out above will entitle the owner (employee) to refuse to entertain the complaint, irrespective of its merits.
24 hour Recording CCTV in operation with the main stairwell and car park.
Permission is NOT granted for any Pictures taken to be uploaded to the internet,
We reserve the right to make changes to our terms, tariff and facilities set out at any time without any notice being given
